Godwin Edudzi Tameklo, the National Democratic Congress (NDC) Director of Legal Affairs, has voiced strong objections following a High Court ruling that mandates the Electoral Commission (EC) to re-collate results for five constituencies where NDC candidates were declared winners. After the court’s decision on December 20, 2024, Edudzi expressed concerns about the lack of evidence supporting the court’s claim of fraud in the original declarations.
In his remarks to the media, Edudzi criticized the judge for dismissing the NDC’s application to halt the re-collation process without substantial proof of wrongdoing. He argued that the court’s assertion of fraud was unfounded, as there was no contrary evidence presented by the EC or any returning officers.
Despite the ruling, Edudzi maintained that the NDC candidates remain the rightful Members of Parliament for the affected constituencies. He accused the EC of bias, pointing out that the re-collation order only targets constituencies won by the NDC, raising questions about the commission’s integrity.
The NDC had sought a judicial review to prevent the EC from re-collating results for constituencies including Dome Kwabenya, Okaikwei Central, and Tema Central, arguing that the commission had become functus officio—unable to act on declared results. However, the High Court ruled in favor of the EC, asserting that there was a valid basis for the re-collation.
As the situation unfolds, Edudzi expressed skepticism about the enforcement of the court order, noting that while the ruling exists, its implementation remains uncertain. He emphasized that the NDC is closely monitoring the developments regarding the re-collation process and remains firm in its stance on the legitimacy of its parliamentary candidates.
